General Terms and Conditions (GTC)

1. Scope of Application These General Terms and Conditions (GTC) apply to all contracts between Nathaniel Williams Digital Marketing and Trading Owner: Nathaniel Williams Buchenweg 88, 34576 Homberg (Efze) (hereinafter: "Provider") and its customers who book services, purchase products, or use other functions (e.g., user account, blog comments, chat function) via the website [your-domain.de]. Deviating terms and conditions of the customer are not recognized unless the Provider expressly agrees to them in writing.
2. Services The Provider offers marketing and consulting services, in particular in the areas of: Social Media Management Creation and Management of Digital Content Digital Advertising Campaigns Bookable Online Services Access to Exclusive Blog Content The specific scope of services is defined by the respective descriptions on the website or by individual agreements with the customer.
3. Contract Conclusion The presentation of services on the website does not constitute a legally binding offer, but rather a non-binding invitation to the customer to submit an offer. By booking or placing an order via the website, the customer submits a binding offer to conclude a contract. The provider can accept this offer by sending an automated order confirmation via email or by express acceptance.
4. Prices and Payment Terms All prices are in euros (EUR) and include statutory VAT unless otherwise stated. Payment is made using the payment methods offered on the website (e.g., credit card, PayPal, instant bank transfer). The invoice amount is due immediately. For customized services, a prepayment or deposit may be required – the customer will be informed of this before the contract is concluded.

The right of withdrawal expires for fully performed digital services if the customer has expressly consented to the commencement of the service before the end of the withdrawal period.

8. Rights of Use Depending on the type of service, the provider grants the customer simple, non-transferable rights of use to delivered digital content. The distribution, reproduction, or commercial use of provided services or content without express permission is prohibited.
9. Liability The provider is liable only for damages resulting from an intentional or grossly negligent breach of duty. In cases of slight negligence, the provider is liable only for damages resulting from injury to life, body, or health, or from the breach of essential contractual obligations (cardinal obligations).

11. Changes to the Terms and Conditions The provider reserves the right to amend these Terms and Conditions at any time. For contracts already concluded, the Terms and Conditions valid at the time of the order apply.
12. Applicable Law, Jurisdiction The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For merchants and legal entities, the exclusive place of jurisdiction is the provider's registered office.
13. Severability Clause Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
